Terms of Service

These Terms of Service govern your use of Birthdly (birthdly.com), a free birthday calendar operated by an individual developer. By using Birthdly, you agree to these terms. If you do not agree, do not use Birthdly.

The service

Birthdly lets you keep a calendar of birthdays, either in your browser or in an account you create by signing in with Google, and optionally sync it with Google Calendar and import birthdays from Google Contacts. Birthdly is provided free of charge. Features may change, and the service may be suspended or discontinued at any time.

Your account

• You sign in with your Google account and are responsible for keeping access to it secure.
• You must be at least 13 years old, or the minimum age required in your country, to use Birthdly.
• You can stop using Birthdly at any time and ask us to delete your account as described in the Privacy Policy.

Your content

You keep all rights to the birthdays and other information you add. You give Birthdly permission to store and process that information only to provide the service to you. You are responsible for the information you add and confirm that you have the right to add it.

Acceptable use

You agree not to:

• use Birthdly for any unlawful purpose or in violation of others' rights;
• attempt to access other users' data or interfere with the security or operation of the service;
• overload, scrape, or reverse engineer the service, or use automated means to access it beyond normal personal use.

We may suspend or terminate access for anyone who violates these terms.

Google services

Using Google sign-in, Google Calendar, and Google Contacts through Birthdly is also subject to Google's own terms and policies. How Birthdly handles Google user data is described in the Privacy Policy.

Disclaimer of warranties

Birthdly is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted or error-free, that calendar sync will always work, or that data will never be lost. Keep your own copy of information that is important to you.

Limitation of liability

To the maximum extent permitted by law, the operator of Birthdly is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the service. Because Birthdly is free, the total liability for any claim related to the service is limited to zero, or the lowest amount permitted by law.

Changes to these terms

We may update these terms from time to time. When we do, we change the effective date above. Continuing to use Birthdly after a change means you accept the updated terms.
